TERMS & CONDITIONS

These Terms & Conditions govern access to and use of www.boohz.com (the “Website”) and purchases made through it. By using the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website.

1. About Boohz

The Website is operated by Booch Beverages Pvt Ltd (“Boohz”, “we”, “us” or “our”). Our contact details are set out in section 16.

2. Eligibility and account responsibility

You must be legally capable of entering into a binding contract under applicable law to place an order. If you use an account, you are responsible for keeping its login details confidential and for activity carried out through it. Please provide complete, current and accurate information.

3. Website use

You may use the Website only for lawful, personal and non-commercial purposes. You must not:

  • misuse the Website, attempt unauthorized access, introduce malicious code or interfere with its operation;

  • use automated tools to scrape, copy or extract Website content without permission;

  • impersonate another person, submit false information or use another person’s payment details without authority; or

  • use the Website or its content in a way that infringes rights or violates applicable law.

4. Product information

We aim to present product descriptions, images, ingredients, quantities, prices and other information accurately. Packaging, color and appearance may vary slightly from images displayed. Product-specific food, labeling and manufacturer information should be reviewed on the relevant product page and the separate Manufacturing Details page (boohz.com/manufacturing-details) before purchase.

 

Product information on the Website is general information and is not medical advice. Please review ingredients and allergen information and seek professional advice where appropriate. Do not use a product if you are allergic or sensitive to an ingredient.

5. Prices and taxes

Prices are shown in Indian Rupees and include or exclude taxes as indicated on the Website or at checkout. The total payable amount, including applicable taxes and shipping charges, will be shown before you confirm the order. We may correct genuine pricing or description errors. If an error affects an order already placed, we will contact you and provide an appropriate option, including cancellation and refund where applicable.

6. Orders and acceptance

Your order is an offer to purchase the selected products. Receipt of an order confirmation does not by itself mean that we have accepted the order. Acceptance occurs when the order is dispatched, unless we expressly state otherwise. We may refuse or cancel an order for legitimate reasons, including product unavailability, payment failure, suspected fraud, incorrect pricing, delivery limitations or breach of these Terms. If we cancel a prepaid order, we will refund the applicable amount in accordance with the Cancellation & Refund Policy.

7. Payment

Payments are processed through third-party payment service providers. You authorize the applicable provider to process the payment information submitted by you. We do not directly store complete card, UPI or banking credentials. An order may be held or canceled if payment is not successfully authorized or verified.

8. Shipping and delivery

Dispatch estimates, delivery timelines, serviceability, shipping charges, failed delivery and address requirements are governed by the Shipping Policy. Delivery dates are estimates unless expressly guaranteed. Please inspect the order promptly after delivery.

9. Cancellations, refunds, returns and replacements

The Cancellation & Refund Policy explains when an order may be canceled and how approved refunds are processed. The Return & Replacement Policy applies to damaged, defective, incorrect or incomplete orders. Because the products are consumable food and beverage products, change-of-mind returns and returns based only on personal taste preferences are not accepted, subject always to applicable consumer rights.

10. Promotions and discount codes

Promotions, offers and discount codes may be subject to additional terms, validity periods, eligibility criteria and usage limits. They cannot be exchanged for cash and may not be combined unless expressly permitted. We may withdraw or correct a promotion where required by law or where there is misuse or a genuine error, without affecting rights already accrued.

11. Intellectual property

The Website and its content, including the Boohz name, logos, product names, text, graphics, photographs, design and software, are owned by or licensed to us and protected by applicable intellectual-property laws. No right is granted except the limited right to use the Website for its intended purpose.

12. Third-party services and links

The Website may rely on or link to third-party services, including payment, hosting, analytics and logistics providers. Those services may be governed by their own terms and privacy policies. We are not responsible for third-party sites or services outside our control, but this does not limit any responsibility we have under applicable law.

13. Availability and liability

We aim to keep the Website available and information current, but uninterrupted or error-free operation cannot be guaranteed. To the maximum extent permitted by law, we will not be liable for indirect or consequential loss that was not reasonably foreseeable. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, or any statutory rights or remedies available to consumers, including rights relating to defective, deficient, unsafe, spurious, misdescribed or late-delivered goods or services.

14. Privacy

Our collection and use of personal information are described in the Privacy Policy, which forms part of this coordinated policy set.

15. Changes, governing law and severability

We may update these Terms to reflect changes in our operations, the Website or applicable law. The “Last updated” date identifies the latest version. Changes apply prospectively unless law requires otherwise. These Terms are governed by the laws of India. Subject to mandatory consumer-protection jurisdiction, courts in Bengaluru, Karnataka will have jurisdiction. If any provision is held invalid or unenforceable, the remaining provisions will continue to apply.

16. Customer support and grievance redress

For ordinary order or support queries, contact us using the details below. If customer support does not resolve a consumer grievance, you may escalate it to the Grievance Officer. In line with the Consumer Protection (E-Commerce) Rules, 2020, consumer grievances will be acknowledged within 48 hours of receipt and redressed within one month from the date of receipt, and we aim to resolve most grievances sooner wherever possible.
